How Do I Sell My Home When My Job Is Relocating Me Out of State?
The short answer
How do you sell your Orange County home when your job is relocating you out of state? Start with your start date and your employer's relocation benefits, then decide whether to sell before you leave or after. Learn the tax rules early: the federal home sale exclusion, a possible partial exclusion for a job move, California's real estate withholding, and how relocation pay is taxed. A lender and CPA can help you plan the money side.
Where Do I Start?
A job transfer comes with a deadline you didn't pick, so set the order of steps right away.
I'm Jeanette Nelson, a REALTOR® with Jeanette Nelson Real Estate, Keller Williams Realty, serving Orange County, Huntington Beach, Costa Mesa, Fountain Valley, and surrounding areas. When a job moves a family out of California, the house is often the biggest piece of the plan. Here's how to think it through.
This is general information, not tax or legal advice. Talk with a CPA and your employer's relocation team about your own situation.
Start with three questions:
- When do you need to be at the new job?
- What does your employer's relocation package cover? Ask in writing.
- Do you need the sale proceeds to buy your next home?
Should I Sell Before or After I Move?
Selling before you move means you know your numbers before you buy, and you're not paying for two homes. You may need short-term housing, or a rent-back after closing. Read Can I Sell My House and Rent It Back for a Few Months While I Move?
Selling after you move lets you prepare the home without living in it, and showings are simpler. You'll carry the mortgage, taxes, insurance and upkeep while it's on the market, and you'll handle the sale from a distance.
Ask your escrow officer early how signing works from out of state.
How Are Taxes Handled on the Sale?
The federal exclusion. IRS Publication 523 says you may exclude up to $250,000 of gain, or $500,000 if married filing jointly, if you meet the ownership and use tests. Generally that means owning and living in the home for at least two of the last five years.
A partial exclusion for a job move. If you haven't lived there two years, Publication 523 describes a work-related exception. One example is taking or being transferred to a new job at least 50 miles farther from the home than your old work location. The exclusion is then prorated by how long you met the tests.
California withholding. The Franchise Tax Board (FTB) says that unless an exemption applies, 3 1/3 percent of the sales price is generally withheld at closing. The principal residence exemption on Form 593 can apply, and the form has to be completed before closing. Read more in Will California Withhold Tax When I Sell My Home and Move Out of State?
FTB also notes that an exemption from withholding does not remove your duty to file a California return and pay any tax due on the sale.
Is My Relocation Package Taxable?
Often, yes. IRS Publication 15-B says that a 2025 federal law ended the exclusion for moving reimbursements for most workers. It still applies to active-duty members of the Armed Forces moving under military orders.
The IRS instructions for Form 3903 also limit the moving expense deduction to Armed Forces members. So for most people, moving help from an employer counts as income. Ask your employer whether they "gross up" the payment to cover taxes, and ask your CPA how to plan for it.
What About My Prop 13 Tax Base and California Residency?
Your Prop 13 base stays with your California home. If you keep ties to California, or keep the home as a rental, the tax picture changes.

Frequently asked questions
Can I sell my house after I've already moved?
Yes. Many sellers move first. You'll keep paying the home's costs until it sells, and you can usually sign closing documents remotely.
Do I qualify for the home sale exclusion if I lived there less than two years?
Possibly a partial one. IRS Publication 523 describes a work-related exception, such as a new job at least 50 miles farther from the home.
Will California take money out at closing?
FTB says 3 1/3 percent of the sales price is generally withheld unless an exemption applies, such as the principal residence exemption on Form 593.
Is the moving money from my employer taxable?
For most workers, yes. IRS Publication 15-B says the moving reimbursement exclusion now applies only to active-duty Armed Forces members under military orders.
